Terms.

These terms apply to all rental orders placed with Modco Rentals. By submitting a rental request you are agreeing to the conditions outlined below. Please read them before submitting.

Effective date: January 1, 2025

Rental access is available to established trade customers whose accounts are current and in good standing — meaning no overdue balances or missed payments.

New customers are required to complete a credit application and provide three business references before a rental order can be confirmed. All accounts must be current before an order ships.

All rental quotes are estimates until confirmed in writing by Modco Rentals. Submitted pricing is net — no volume discounts or promotional rates apply to rental orders.

We reserve the right to adjust pricing with advance notice if underlying costs change — including materials, freight, labor, or currency fluctuations — even where those changes were reasonably foreseeable at the time of quoting.

We understand plans change. Cancellation fees are calculated as follows:

  • More than 2 weeks before shipment: No charge.
  • Less than 2 weeks but more than 48 hours before shipment: 50% of the total rental order will be invoiced.
  • Less than 48 hours before shipment: 100% of the total rental order will be invoiced.

Early termination of an active rental must be made in writing. The renter is responsible for the remaining balance of the rental period regardless of early return.

The rental period begins on the date the order departs our warehouse. There is no maximum rental duration. The minimum rental period is one week.

Invoices are issued weekly. Pricing for any period beyond the first week is prorated. No deposit is required. The renter is responsible for any payment processing fees associated with their chosen payment method.

Failure to pay an invoice on time gives Modco Rentals the right to terminate the rental agreement immediately, without prejudice to our right to collect the full outstanding balance.

Early return of goods does not entitle the renter to a refund or reduction of the agreed rental price.

A material handling fee is applied to all rental orders. This fee varies by fulfillment location and reflects the operational costs associated with preparing, loading, and receiving the kit. The applicable fee will be included in your rental quote.

All outbound and return shipping costs are the renter's responsibility unless otherwise agreed in writing. Freight charges are not included in the rental rate and will appear as a separate line item on your invoice.

We can assist with arranging transportation if requested — all costs are still billed to the renter.

All kits ship in Modco-owned cases, crates, and packaging. These must be returned with the kit in the same condition they arrived. The renter is financially responsible for any damaged or missing packaging materials.

All rented goods remain the property of Modco Rentals at all times. The renter may not sell, sublease, pledge, modify, or otherwise transfer the goods to any third party.

The renter is responsible for the goods from the moment they depart our warehouse until the moment they are received back and accepted by our team. This includes loss, theft, or damage from any cause — including force majeure.

In the event of theft, the renter must file a police report within 24 hours and provide us with a copy immediately.

The renter agrees to notify us immediately in writing of any seizure, legal proceeding, or other event that could jeopardize our ownership rights over the rented goods.

The renter is required to maintain adequate insurance coverage throughout the rental period — at minimum, coverage for the full replacement value of the rented goods against fire, water damage, and theft. Upon request, the renter must provide proof of insurance coverage.

Rented goods must be returned in the same condition they were received — clean, unmodified, and free of paint, adhesive damage, drill holes, or other alterations.

Every returned kit is inspected by our team. The renter may request to be present at the inspection in writing, submitted no later than the time of return. Absent that request, the renter accepts the findings of our inspection as conclusive.

Damage documentation and invoicing will be completed and sent within 14 days of the return date. Modco Rentals reserves the right to invoice for damage that is not immediately visible at the time of initial inspection.

The renter may not carry out repairs on rented goods. Any maintenance needs should be reported to us immediately at info@modco.com.

Minor damage — repairable issues such as adhesive residue, surface scuffs, or worn hook-and-loop tape — will be repaired by our team and billed at $120 per hour, invoiced in 15-minute increments.

Significant damage — any frame or component that cannot be returned to rental service, including drilled holes, bent or broken structural elements, or cut/shortened frames — will be charged at 30% below retail list price per affected item.

Goods are considered returned only when the complete kit has been received at the correct warehouse. Partial returns do not stop the overdue clock.

For each calendar day a kit is overdue, a fee equal to 2% of the total rental order will be charged, capped at $500 per day.

Returns must be made to the warehouse the kit originated from. If goods are returned to a different location, the renter is responsible for all costs to redirect them, and the return will not be considered complete until the kit arrives at the correct warehouse.

Items not returned within 10 business days of the return due date are classified as lost and charged at full retail list price.

If the renter needs additional time to locate missing items, the daily overdue fee (2% of order, max $500/day) continues to accumulate until all items are received. The order is not classified as returned until the complete kit is back in our possession.

Modco Rentals is liable only for direct damages arising from a failure to meet our contractual obligations — and only where that failure is the result of intentional misconduct or fraud. Our liability is limited in all cases to the invoice value of the goods in question. Where damages are covered by insurance, our liability does not exceed the amount actually paid out.

We are not liable for indirect, consequential, or incidental damages of any kind, including lost profits, production interruptions, increased costs, loss of clients, or third-party claims.

Modco Rentals does not warrant the structural stability of any construction built using rented goods. Decisions about rigging, reinforcement, and structural integrity are solely the renter's responsibility.

Any claim against Modco Rentals must be brought within one year of the date the renter became aware of the underlying facts.

All trademarks, designs, and proprietary features of the rented goods remain the intellectual property of their respective owners. Rental of goods does not transfer any intellectual property rights to the renter. The renter must not remove, obscure, or alter any marks or identifiers on the goods.

These terms are governed by the laws of the State of Georgia. Any disputes arising from a rental agreement will be resolved in the courts of competent jurisdiction in Georgia.

If any individual provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
